Presenter: This is the EcomBack ADA website lawsuit report for the third quarter.
Narrator: 2,805 lawsuits, January through September — down 9.69% from 3,106 last year. Still more than ten new lawsuits every single day.
Narrator: California leads with 652. New York fell 29.8% to 628. Florida dropped 30.7%. But growth moved inland: Indiana +164%, Wisconsin +128%.
Narrator: 253 plaintiffs filed all of them. Just 30 filed 1,440 — over half. Michael Sandoval alone filed 242.
Narrator: 40 law firms. Manning Law 570, Equal Access 548, Gottlieb & Associates 308. Eleven firms account for 81.46% of all cases.
Narrator: Food and fashion carried 59% of the risk between them — 853 and 801. Eight industries took 93.44% of all filings.
Narrator: Shopify stores took 1,288 lawsuits — 45.92%. Custom-coded sites 929. WordPress 355. No platform makes a store compliant on its own.
Presenter: One in four of these lawsuits hit a site that already had an accessibility widget. A widget is not a defense.
Narrator: 345 CIPA website privacy lawsuits. Q1 94, Q2 113, Q3 138 — rising every quarter. The two-firm monopoly broke: a dozen new firms entered, 42 cases moved to federal court.
Narrator: SB 690 was signed September 30, 2026. From Jan 1, private pen-register claims are gone — retroactive to 2025. Wiretapping claims stay open. Filers will shift, not stop.
Narrator: In Europe, the EAA produced its first rulings. A French court ordered Carrefour to fix its site at €500/day. The law follows who you sell to, not where you're based.

Summary
-
State Litigation Patterns Shift
California, New York, Florida, Illinois, and Minnesota were the leading states from January through September 2026. California held the top spot with 652 filings, while Indiana was the fastest growing state, surging 164.29% (42 last year to 111 this year), followed by Wisconsin at +127.78%, highlighting the evolving geographic landscape of ADA website litigation.
-
Repeat Plaintiffs Continue to Drive Litigation
Although 253 plaintiffs filed ADA website lawsuits from January through September 2026, litigation stayed highly concentrated among a small group of repeat filers. The 30 most active plaintiffs accounted for 51.34% (1,440 lawsuits, more than half of all filings), while just 11 plaintiff law firms filed 81.46% of all cases nationwide.
-
Shopify Remains the Most Targeted Platform
Shopify continued to account for the largest share of ADA website lawsuits, 45.92% (1,288), followed by custom coded websites (33.12%) and platforms including WordPress (12.66%), Squarespace, Wix, and Magento. Litigation continues to affect organizations across virtually every major website platform and technology stack.
-
Accessibility Widgets Continue to Face Legal Scrutiny
From January through September 2026, 675 ADA website lawsuits (24.06%) involved websites using an accessibility widget or overlay, compared with 751 during the same period in 2025. Their continued presence in litigation reinforces that automated accessibility tools alone do not eliminate ADA compliance risk and should be paired with comprehensive remediation.

Widget Usage Fails to Prevent ADA Lawsuits: 2026 (Jan - Sep) Analysis
Despite the growing adoption of accessibility widgets, 675 ADA website lawsuits (24.06%) were filed against websites using accessibility widgets from January through September 2026, compared with 751 (24.18%) during the same period of 2025. This shows that accessibility widgets alone do not ensure ADA compliance, and full WCAG conformant remediation remains essential to reduce litigation risk.
Lawsuits Against Websites with Accessibility Widgets: Q3 2026 (675) vs 2025 (751)
- 2026 (675)
- 2025 (751)
Despite claims that accessibility widgets offer a simple path to ADA compliance, lawsuits against websites using them stayed high through the first three quarters of 2026. A total of 675 lawsuits were filed against websites with accessibility widgets, compared with 751 in the same period of 2025, a decrease of 76 cases.
Month by month, widget-related filings ran well above 2025 early in the year: January (92 vs. 73), February (93 vs. 77), and March (91 vs. 59), then fell below 2025 levels from April through September: April (72 vs. 83), May (77 vs. 92), June (71 vs. 80), July (68 vs. 109), August (77 vs. 88), and September (34 vs. 90).
Widget-installed sites accounted for 24.06% of all ADA website lawsuits (675 of 2,805). The data continues to show that accessibility widgets alone do not prevent lawsuits. Businesses relying only on overlay- or widget-based tools remain frequent targets, reinforcing that full WCAG-conformant remediation is the most effective way to reduce legal risk and deliver meaningful accessibility.
ADA Lawsuits Filed Against Website Platforms (Jan–Sep 2026)
Website platforms play a critical role in enabling businesses to build and manage their digital presence. While many platforms offer accessibility features and third-party tools, ADA website accessibility lawsuits can still occur when accessibility is not effectively incorporated into the overall user experience. Ultimately, responsibility for ADA compliance rests with the website owner.

Digital Accessibility Trends: Q3 2026 Snapshot
As digital accessibility gains global momentum, new laws, enforcement actions, and the first major court rulings continue to reshape compliance for businesses worldwide. Three developments stand out heading into the final quarter of 2026.
CIPA Website Litigation: Q3 2026 Analysis
California’s wave of CIPA (California Invasion of Privacy Act) website lawsuits continued to build through the first three quarters of 2026, and the third quarter brought two structural changes worth watching. We tracked 345 CIPA website lawsuits filed between January 1 and September 30, 2026 and unlike the first half, when the field was defined by two firms filing in a single courthouse, Q3 saw new filers enter and new venues open up.
Filings rose every quarter
CIPA filings climbed steadily across 2026, with the third quarter the busiest yet:

Website Accessibility Laws in 2026
U.S. website accessibility risk remains high, even as federal enforcement eases. Courts continue to treat WCAG 2.1/2.2 Level AA as the de facto standard under the ADA, while the current administration’s deprioritization of federal enforcement is expected to increase not reduce private litigation risk, since the real pressure has always come from private plaintiffs. With 95.9% of top websites still non compliant and over 3,000 federal lawsuits filed in 2025, the exposure is as real as ever.

EAA Enforcement: The First Rulings Land
The European Accessibility Act is now being enforced but unevenly, and nothing like the U.S. lawsuit machine. France has produced the first real courtroom rulings (Carrefour was ordered to fix its site under a €500/day penalty; Auchan won a dismissal on a technicality, now under appeal), Germany is seeing competitor warning letters, and regulators in Sweden and the Netherlands are running audits. No EAA fine has yet been confirmed anywhere in the EU but the law applies based on who you sell to, not where you’re based, so non-EU sellers can be in scope.

SB 690 Is Now Law: CIPA Relief, With an Asterisk
California’s SB 690, signed September 30, 2026 and effective January 1, 2027, ends the wave of private “CIPA shakedown” lawsuits over website tracking by removing the private right to sue for pen register and trap and trace claims leaving only the Attorney General and it reaches back retroactively to claims filed on or after January 1, 2025. But the win is narrow: it doesn’t make the conduct legal, and CIPA’s wiretapping provisions (§§ 631/632) remain open to private plaintiffs, so litigation is expected to shift rather than stop. Keep your consent and cookie practices tight.

Month by month: January 32, February 32, March 30, April 36, May 24, June 53, July 50, August 57, and September 31. (September’s lower figure likely reflects the reporting lag seen elsewhere in this report and may rise as late added cases are recorded.)
The two-firm monopoly cracked
The single most important development: the duopoly that filed every CIPA website case in the first half no longer holds. Through Q3, Pacific Trial Attorneys, APC (146 cases, 42.3%) and Brodsky Smith (135 cases, 39.1%) still dominate together 81.4% of all filings but at least a dozen other firms entered the space during the third quarter, every one of them filing its first CIPA website case in July or later.
| Plaintiff Firm | Lawsuits | Share |
|---|---|---|
| Pacific Trial Attorneys, APC | 146 | 42.30% |
| Brodsky Smith | 135 | 39.10% |
| Bursor & Fisher, P.A. | 13 | 3.80% |
| Tauler Smith LLP | 11 | 3.20% |
| Swigart Law Group, APC | 11 | 3.20% |
| Potter Handy, LLP | 11 | 3.20% |
| Gutride Safier LLP | 5 | 1.40% |
| All other firms (9) | 13 | 3.80% |
The new entrants collectively filed 64 cases (18.6%) of a meaningful crack in what had been a closed, two firm market. The pattern among the originals also shifted: Pacific Trial Attorneys front loaded its year, peaking at 39 filings in June before easing through Q3, while Brodsky Smith filed at a steadier pace throughout.
Federal courts entered the picture
In the first half of 2026, every CIPA website case was filed in California state court. That changed in the second half. Through Q3, 42 cases (12.2%) were filed in federal district courts primarily the Northern (16), Southern (13), and Central (10) Districts of California. Venue also broadened beyond Los Angeles: while Los Angeles County Superior Court still led with 245 cases (71.0%), that share fell from roughly 90% at mid-year as filings spread to San Diego (30), Alameda (10), San Bernardino (7), and the federal districts.
| Court | Lawsuits | Share |
|---|---|---|
| CA Superior – Los Angeles County | 245 | 71.00% |
| CA Superior – San Diego | 30 | 8.70% |
| U.S. District Courts (CA N/S/C/E + other) | 42 | 12.20% |
| CA Superior – Alameda | 10 | 2.90% |
| CA Superior – San Bernardino | 7 | 2.00% |
| CA Superior – Orange | 4 | 1.20% |
| Other CA Superior courts | 7 | 2.00% |
All but one of the 345 cases were filed in California; a single case appeared in New York.
Which industries are targeted
CIPA filers chase a different industry mix than ADA accessibility filers, skewing toward retail and services that run heavy third party tracking:
| Industry | Lawsuits | Share |
|---|---|---|
| Lifestyle, Fashion, Clothing & Apparel | 82 | 23.80% |
| Financial & Business Services | 52 | 15.10% |
| Furniture, Lighting, Home Decor & Kitchen | 39 | 11.30% |
| Fitness & Sports Accessories | 26 | 7.50% |
| Medical & Health | 24 | 7.00% |
These top five industries account for 223 lawsuits — 64.6% of all CIPA filings. Shopify was again the most common platform (123 cases), consistent with its e-commerce footprint.
Your accessibility widget is not privacy protection
As in the first half, having an accessibility widget installed did nothing to prevent a CIPA claim: 33 of the 345 sued websites (9.6%) had an accessibility widget in place. Overlays address (and even then, only partially) accessibility; they do not touch the cookies, pixels, analytics, and session tools that CIPA lawsuits are built around.
What this means for businesses
CIPA risk and ADA risk continue to arrive together the same California courts, many of the same consumer facing online retailers, and now a widening group of plaintiff firms. With SB 690 removing the private right of action for pen register claims as of January 1, 2027 (see Digital Accessibility Trends, above), expect filers to lean harder on the CIPA wiretapping theories that remain open to private suit. The durable protection is unchanged: inventory every cookie, pixel, tag, and script your site loads, confirm your consent tool actually blocks third party tracking before a visitor opts in, and keep privacy disclosures aligned as the site changes.
