This is the EcomBack ADA website lawsuit report for September 2026.
September brought 200 new website accessibility lawsuits, down 28% from August. That's still nearly seven new lawsuits every single day. A quieter month is not a safe month.
New York took the lead with 77 filings, ahead of Florida and California. Five states produced 98.5% of every filing. California's filings nearly halved, from 78 to 41.
Just 20 plaintiffs filed 137 lawsuits. More than two in every three. Willie Macon alone filed 21 lawsuits in 30 days.
Five firms filed 126 lawsuits, 63% of the month. Gottlieb & Associates led with 45.
Food and fashion carried 56% of the risk between them. Six consumer industries accounted for over 90% of all filings.
Shopify stores were hit again. 89 lawsuits, 44.5% of the month. No platform makes a store compliant on its own.
A widget on your site is not a defense.
34 of September's lawsuits targeted sites already running an accessibility widget. That's one in six.
In California, 31 CIPA privacy lawsuits, down from 51. Damages can reach $5,000 per violation. Brodsky Smith filed 11 of them.
On September 30th, California signed SB 690. From January 2027, private claims over website tracking under its pen register rules will end. But wiretapping claims remain, and ADA lawsuits are untouched.
