Protecting Your Business: Website Accessibility Expert Discusses ADA Compliance Challenges

According to our mid-year report, businesses across the U.S. faced a total of 2,014 web accessibility-related lawsuits in the first half of 2025, representing a 37% increase year-over-year. This surge in litigation serves as a wake-up call for all businesses to prioritize digital compliance.

Nayan Padrai, founder of EcomBack and an ADA expert, spoke to News Press Now to caution businesses about these ADA website compliance lawsuits. Particularly, in Missouri, where 48 lawsuits have been filed, raising concerns for multiple reasons. Many of these cases involve serial plaintiffs and use boilerplate, cut-and-paste filings that can overwhelm small businesses unprepared to handle such legal challenges.

“A lot of the time, what happens is that folks are not very well aware of what the issues on the website are, how to fix those issues, how to test for those things, how to audit them,” Padrai said.

Padrai emphasizes that businesses have limited options when faced with lawsuits. “When small businesses get hit with the lawsuit, they have two choices, either figure out the quickest, simplest, cheapest way to solve the problem or go to court in a protracted legal case, which drains a lot of energy and resources and people are intimidated by the process.”

He also stresses that suing every small business in Missouri is not an effective way to achieve accessibility. To assist businesses in becoming aware of these issues, EcomBack offers free audits.
