During the discussion, EcomBack founder Nayan Padrai shares findings from the company’s most recent report, revealing a staggering 37% increase in ADA website lawsuits in the first half of 2025 compared to the previous period. What’s even more concerning is that a small group of plaintiffs and law firms account for the majority of cases, with lawsuits now spreading across more states and targeting smaller, more vulnerable businesses.
Padrai also highlights another concerning trend: the rise in demand letters, which are intimidating some small businesses into shutting down their websites altogether to avoid risks.

Padrai warns that strict, unforgiving legal standards may be counterproductive. Businesses are walking away from accessibility altogether—not because they don’t care, but because they’re afraid.
“Making the world more accessible by suing every small business in America is probably not the best use of resources,” Padrai said. “A lot of small businesses are selling online to barely pay their bills. When they have things like this happen, it shakes their faith.”
