ADA Website Accessibility Lawsuits
June 2024 Report
Summary
In June 2024, a total of 232 ADA website lawsuits were filed, highlighting ongoing challenges in web accessibility.
Notably, nearly 80 (34.05%) of these lawsuits targeted Shopify-based websites, indicating significant scrutiny on e-commerce platforms. The Lifestyle, Fashion, Clothing, and Apparel sector was particularly affected, with 108 cases underscoring the vulnerability of this industry to web accessibility-related litigation.
The distribution of lawsuits was heavily concentrated in specific states: New York led with 117 cases, followed by Florida (45), California (22), and Pennsylvania (28), with 20 cases in the remaining states.
A small number of plaintiffs were particularly active, with 13 individuals filing over 51% of the lawsuits and 60 plaintiffs collectively filing all cases recorded in June. Additionally, 10 law firms (a surprisingly small number) were responsible for nearly 80% of the lawsuits, pointing to a trend where a few entities dominate this legal landscape.
Also, approximately 43 (18.53%) of the June 2024 cases involved websites that leverage accessibility widgets, suggesting that merely having such tools may not suffice to avoid legal action.
Overall, this report underscores the urgent need for businesses to prioritize accessibility to mitigate legal risks and ensure a more inclusive digital landscape.
