Summary

In March 2024, the increase in lawsuits suggests a growing enforcement of ADA compliance and a strong likelihood of continued legal scrutiny in the coming months, highlighting the need for businesses to prioritize website accessibility.

A total of 279 ADA-related website lawsuits were filed this month, marking a 4.49% increase from February’s 267. Most lawsuits originated from New York (138), California (72), and Florida (49).

The lifestyle and fashion sector was majorly impacted, facing 79 lawsuits, while the restaurant and beverage industry followed closely with 65, suggesting that companies in these sectors should proactively assess and improve their website accessibility to mitigate legal risks.

Notably, 14 plaintiffs filed over 51% of the lawsuits, with plaintiff Derrick Anderson leading with 23 cases filed. Twelve law firms were responsible for over 91% of the lawsuits, with Mars Khaimov Law, PLLC filing the most at 55 cases. The fact that a small number of plaintiffs and law firms are responsible for the majority of cases points to a strategic approach that businesses should be aware of when trying to prevent litigation.
